International conference in Dubrovnik brought together the world's leading arbitrators, lawyers and builders

ICC FIDIC Conference on International Construction Contracts and Dispute Resolution
In Dubrovnik, on the 14th and 15th of October, in the Hotel Excelsior Dubrovnik the conference of the International Chamber of Commerce (ICC) and the International Federation of Consulting Engineers (FIDIC) entitled Conference on International Construction Contracts and Dispute Resolution was successfully held. The conference was co-organised by ICC Croatia and the Croatian Chamber of Commerce (HGK). The conference brought together more than 200 engineers, corporate lawyers in construction companies, lawyers specialising in construction contracts and construction disputes, as well as representatives of financial institutions and agencies from about 30 countries around the world. The conference provided participants with information on the latest developments and trends in the profession, as well as insight into the real world and specialist knowledge.

 

At the opening of the conference, the general secretary of the Croatian Chamber of Commerce and ICC Croatia, Marina Rožić, pointed out that HGK and ICC Croatia have a long-standing tradition of conferences of this type, where businesspeople and members are helped to transfer and implement international trade rules and professional conduct guidelines in their business. She added that lawsuits and disputes in the construction sector are a constant phenomenon. The consequences of the shortage of construction materials and raw materials due to disruptions in the supply chain and their rising costs, which have risen sharply due to the Covid-19 pandemic and the Russian invasion of Ukraine, are very tangible. The current and upcoming energy crisis is expected to further fuel uncertainty in construction contracts. The construction sector in Croatia is faced with several unprecedented factors - despite price increases, there is more work and projects than ever before, so construction companies could play a key role in increasing Croatian GDP and revitalising certain regions of Croatia. Marina Rožić also pointed out that a well-drafted contract can be a key ally for partners and all interested parties, and FIDIC contracts are known worldwide for their balanced distribution of risks.

The Chief Executive Officer of FIDIC, Nelson Ogunshakin, expressed his satisfaction that finally all interested parties gathered live after two and a half years of online communication and added that the acceptance of the FIDIC contract confirms the technical acceptability for financing - from the EU, the European Investment Bank, and confirms that the entity is able to provide quality infrastructure, without corruption and without problems with sustainability.

Quamrul Hasan from the World Bank spoke about the experiences of financial institutions with construction contracts, who emphasised the importance of security in contracting and maximising the value of FIDIC contracts in developing countries. The president of the Croatian ICC Commission for Arbitration and ADR, Jasminka Čorda Truhar, from the law firm Hanžeković & Partners, stated that arbitrations are quite common in our country, emphasising that arbitration allows the parties to reach a final solution relatively quickly, which is exceptional important in business relations.

On the second day of the conference, Claudia Salomon, President of the International Court of Arbitration of the ICC, the world's leading arbitration institution, spoke about ways to solve the problems of the parties when it comes to construction contracts and dispute resolution in the construction sector, and what needs to change to help lawyers, engineers and other parties involved in the procedure.

When it comes to the arbitration practice, new technologies that inevitably change it must also be taken into account. And on the second day of the conference, Davor Babić, professor of private international law and international arbitration at the Faculty of Law of the University of Zagreb, spoke about the related procedures for resolving claims and disputes, about Dispute Panels and ICC arbitrations in construction cases.
